These Terms govern your use of Midnight Tracer ("the Service"). By using the Service, you agree to these Terms.
The Service is an anonymous horror/paranormal community operated with an automatically generated anonymous account identifier and a pseudonymous device identifier, without requiring the user to enter registration details. It provides boards, comments, likes, reports, blocks, and haunted spots that users pin directly on a map. You must be at least 14 years old to use the Service.
You agree to:
• Use the Service for lawful purposes only
• Respect the rights of others (copyright, reputation, privacy)
• Comply with these Terms and Community Guidelines
The following are strictly prohibited:
• Harassment, insults, profanity
• False information
• Spam, repeated identical content
• Self-harm/suicide promotion or harmful content
• Sexual content involving minors
• Disclosing others' personal information
• Copyright infringement
• Fraud or solicitation of money
• Asserting as fact that a named person, business, or specific address is haunted, a site of death, or a crime scene
• Trespassing on private or restricted property, or inducing others to do so
• Registering — or encouraging visits to — military bases/installations, access-controlled protected zones, disaster/accident areas under access control, or restricted cultural-heritage sites as haunted spots
Violations result in auto-hiding (10 reports) or blocking.
You retain copyright in the content you create. However, you grant the operator a worldwide, non-exclusive, royalty-free license to use (store, reproduce, modify, create derivative works of, publicly transmit, display, and distribute) your content for the purpose of providing, operating, and promoting the Service, and to sublicense these rights to third parties. This license terminates when you delete your content, except for reasonable backups and copies already distributed.
We may remove content or block users for:
• Violations of these Terms or Community Guidelines
• Violations of applicable law
• Accumulated user reports (10+ triggers auto-hide)
• Government or court requests
Reported content is reviewed within a reasonable period where operationally possible. High-priority reports such as child-safety, self-harm promotion, or clearly illegal/harmful content are prioritized. This does not guarantee review within a specific number of hours.
We do not warrant:
• Scientific accuracy of measurements/analysis
• Truthfulness of user-generated content
• Uninterrupted operation
We are not liable for damages arising from use of the Service, to the maximum extent permitted by law.
These Terms are governed by the laws of the Republic of Korea. Disputes related to the Service are subject to the Seoul Central District Court as the court of first instance. Separate terms may apply when expanding to overseas markets.
However, for consumers residing in Japan, the mandatory protections of the Japanese Consumer Contract Act and other applicable mandatory laws take precedence, and the governing-law and jurisdiction provisions of this section do not limit the rights granted to consumers by such mandatory laws.
The map features of this Service may include Google Maps features and content. Your use of those features is also governed by the Google Maps/Google Earth Additional Terms of Service (https://maps.google.com/help/terms_maps/) and the Google Privacy Policy (https://policies.google.com/privacy).
Any person harmed by content that infringes their rights (reputation, privacy, copyright, etc.), including haunted spots and sightings, whether or not a member, may request removal of the content or the posting of a rebuttal by substantiating the infringement to iconic.app.official@gmail.com. Upon receiving such a request, the operator will promptly take necessary measures such as deletion or temporary blocking, and notify both the requester and the content author of the result. The same request can be made via the in-app report feature on each post, sighting, or spot.
